Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using ZenDecide (the “App”), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Purpose of the App

ZenDecide is provided as a lifestyle, entertainment, and personal organization tool. The App is designed to help users explore options, reflect on choices, and receive randomized or user-generated outputs. The App does not provide professional advice, guaranteed recommendations, or objectively correct answers.

3. No Professional Advice; No Reliance

The App and its outputs are for informational and entertainment purposes only and must not be relied upon as a substitute for professional judgment, common sense, or advice from qualified professionals.

ZenDecide does not provide medical, mental health, legal, financial, tax, safety, emergency, or other professional advice. You are solely responsible for evaluating any output generated by the App and for any action or inaction you take based on your use of the App.

4. High-Risk and Safety-Critical Use Prohibited

You may not use the App, or rely on any output from the App, in connection with any situation where error, delay, misunderstanding, or incorrect judgment could result in death, personal injury, medical harm, emotional harm, property damage, financial loss, or other serious consequences.

This includes, without limitation, decisions involving:

  • medical or mental health issues,
  • self-harm or harm to others,
  • emergencies or crisis situations,
  • driving, operating machinery, or other safety-sensitive activities,
  • legal, financial, or business decisions with significant consequences,
  • child safety, elder care, or any other welfare-sensitive situations.

If you are facing an emergency or a situation involving health, safety, self-harm, or possible harm to others, do not rely on the App. Contact local emergency services or an appropriate qualified professional immediately.

5. User Responsibility

You acknowledge and agree that:

  • all decisions you make are your own;
  • you assume all risks arising from your use of the App and any output it generates;
  • you are solely responsible for verifying whether any suggestion, result, or option is appropriate for your circumstances; and
  • Focus Labs Hungary does not control, direct, or make decisions on your behalf.

6. One-Time Purchases

ZenDecide may offer one-time purchases, including premium themes, skins, or other digital features that grant ongoing access to the purchased content. These are not subscriptions and do not create recurring charges.

All purchase transactions are processed by the Apple App Store or Google Play, as applicable. Apple allows users to request refunds through Apple’s refund process, and Google Play handles refunds under its own refund policies. Purchased content may be restorable on eligible devices connected to the same store account, subject to the rules and technical limitations of the relevant platform.

7. Intellectual Property

The App, including its software, design, visual assets, content, branding, trademarks, and all related intellectual property, is owned by Focus Labs Hungary or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, sell, reverse engineer, or exploit any part of the App except as expressly permitted by law.

8. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, Focus Labs Hungary disclaims all warranties, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and uninterrupted or error-free operation.

Focus Labs Hungary does not warrant that:

  • the App will always be available, secure, or error-free;
  • the App’s outputs will be accurate, suitable, useful, or appropriate for your needs;
  • the App will prevent indecision, improve outcomes, or lead to any particular result.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Focus Labs Hungary, its owners, affiliates, officers, employees, contractors, licensors, and partners shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages, including without limitation personal injury, death, emotional distress, lost profits, lost data, lost business opportunities, property damage, or any other losses arising out of or related to:

  • your use of or inability to use the App;
  • your reliance on any output, suggestion, or result generated by the App;
  • any decisions, actions, or omissions taken by you or by others based on the App;
  • any purchase, restoration, or unavailability of digital content;
  • any bugs, downtime, errors, delays, or security issues.

You expressly acknowledge that use of the App is at your sole risk and that you remain exclusively responsible for all decisions and consequences resulting from your use of the App.

10. Indemnification

You agree to defend, indemnify, and hold harmless Focus Labs Hungary, its owners, affiliates, officers, employees, contractors, licensors, and partners from and against any claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your use or misuse of the App;
  • your violation of these Terms;
  • your decisions, conduct, or actions taken in reliance on the App;
  • any claim brought by a third party arising from your use of the App.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or used the App in a harmful, unlawful, abusive, or unintended manner.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to conflict of laws principles. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts of Hungary, unless applicable consumer protection law provides otherwise.

13. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted and the remaining provisions shall remain in full force and effect.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms.
